No law, regulator or court examined in this unit has moved clinical accountability from the clinician to the software or its manufacturer. The professional regulators of every major UK profession, and regulators in Australia, Ontario and the United States, have addressed AI directly and say the same. What changes with AI is what a reasonable clinician is expected to know about the tool.
The unit sets out the roles of provider, deployer and user and where you sit, then applies Bolam, Bolitho, Montgomery and McCulloch to following or overruling an AI recommendation. It gives the measured evidence on automation bias: in one study, very experienced radiologists categorised 45.5 per cent of mammograms correctly when the AI was wrong, against 82.3 per cent when it was right. It covers de-skilling, product liability and a workable minimum for the record when AI has contributed to a decision. It maps to the HEE AI and Digital Healthcare Technologies Capability Framework (2023). Veritant is education, not legal advice.
